Terms of service

The rules for using ChimeIn, what you can expect from us, and what we expect from you.

These terms apply to our website at joinchimein.com and the ChimeIn app atapp.joinchimein.com, including the pages participants use to join sessions (together, the “service”). In these terms, “ChimeIn”, “we” and “us” mean the team that runs ChimeIn, and “you” means anyone who uses the service. How we handle personal information is covered by our privacy policy.

Agreeing to these terms

By creating an account, joining a session or otherwise using the service, you agree to these terms. If you use ChimeIn on behalf of an organisation, such as your employer or school, you confirm that you’re allowed to accept these terms for it, and “you” includes that organisation. If you don’t agree, don’t use the service.

Accounts and teams

  • You must be at least 16 to create an account. Participants can join sessions without one.
  • Give us an email address you control, and keep access to it secure. Anyone who can read your email can sign in as you.
  • You’re responsible for what happens in your account, including what people you invite to your team do.
  • Tell us straight away at [email protected] if you think someone has accessed your account without permission.

The free plan

We offer a free version of ChimeIn so you can try it and use it for smaller sessions. The free plan is provided as is, and it changes as the product does:

  • Features can be discontinued. We may add, change, limit or remove any feature or service on the free plan, or end the free plan entirely, at any time and without notice.
  • Limits can change. Usage limits on the free plan, such as the number of sessions, participants, questions, meetings, AI requests or how long content is kept, can change at any time and without notice.
  • No guaranteed availability. We don’t promise any level of uptime or support for free accounts.

If a change means content in a free account will be deleted, we’ll try to give you a chance to export it first, but we can’t promise to. Keep your own copy of anything you need.

Where paid plans are available:

  • The price, billing period and what’s included are shown when you buy, and form part of these terms.
  • Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time, and your plan stays active until the end of the period you’ve paid for.
  • Fees are non-refundable except where the law requires otherwise or we agree in writing.
  • Prices don’t include taxes unless we say so. You’re responsible for any taxes that apply.
  • We may change prices or what a paid plan includes. We’ll tell you before a change affects a period you haven’t paid for yet, so you can cancel first.
  • If a payment fails, we may move your account to the free plan or suspend paid features until it’s paid.

Your content

“Content” means what you put into ChimeIn: questions, answer options, responses, forms, chat messages, meeting recordings and anything else you create or upload. You keep ownership of your content.

You give us permission to store, copy, process and display your content only as needed to run, secure and improve the service. For example, we show a host’s questions to their participants, and responses to the host. This permission ends when the content is deleted, except for copies kept for a short time in backups or where the law requires us to keep them.

You’re responsible for your content, and you confirm you have the rights to use it. We don’t review content before it’s posted, but we may remove content that breaks these terms.

If you send us feedback or ideas, we may use them without owing you anything. ChimeIn’s software, design, name and logo belong to us, and these terms don’t give you any rights to them beyond using the service.

Acceptable use

Don’t use ChimeIn to:

  • break the law, or help anyone else break it
  • harass, threaten, bully or discriminate against anyone
  • share content that is sexually explicit, violent, hateful, or that you don’t have the rights to
  • send spam, run scams, or collect people’s personal information without a lawful basis
  • collect passwords, payment card numbers, government ID numbers or health information in forms or polls
  • spread malware, or try to break, overload, probe or get around the security or limits of the service
  • scrape the service, access it by automated means other than features we provide, or copy it to build a competing product
  • resell or give others access to the service, except team members on your account

Hosts and participants

If you host sessions or meetings, you’re responsible for how you run them. In particular:

  • Tell participants how you’ll use their responses, and follow the laws that apply to you, including privacy laws.
  • If you turn off anonymous responses, make sure participants know their name may be shown.
  • Get any consent the law requires before recording a meeting.
  • Schools and organisations using ChimeIn with students are responsible for any consent their students or parents need to give.

Participants must follow the acceptable use rules too. Hosts and ChimeIn can remove responses or people from a session.

AI writing help

AI suggestions are generated automatically and can be inaccurate, incomplete or inappropriate. Review anything you use before showing it to your audience. You’re responsible for the questions you publish, including ones based on AI suggestions.

Changes to the service and these terms

ChimeIn is growing, and we regularly change it. We may add, change or remove features, and we may stop offering the service. On the free plan, this can happen without notice, as described above. For paid plans, if we remove a major feature you’re paying for or stop offering the service, we’ll tell you in advance and refund any prepaid fees for the time you can’t use.

We may update these terms and will change the date at the top when we do. If a change is significant, we’ll tell account holders by email or in the app before it takes effect. If you keep using the service after that, you accept the new terms.

Suspension and closing accounts

You can stop using ChimeIn and ask us to delete your account at any time. We may suspend or close your account, or remove access to the service, if you break these terms, if we need to in order to protect people or the service, or if the law requires it. Where it’s reasonable, we’ll tell you first and explain why.

When an account is closed, its content is deleted as described in our privacy policy. Sections of these terms that by their nature should continue, such as content ownership, disclaimers and limitation of liability, still apply.

Disclaimers

We work hard to keep ChimeIn reliable, but to the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise the service will be uninterrupted, error-free or secure, or that content won’t be lost.

Limitation of liability

To the extent the law allows:

  • We aren’t liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue, data or goodwill.
  • Our total liability for any claim relating to the service is limited to the greater of what you paid us in the 12 months before the claim, or 100 US dollars.

Nothing in these terms limits liability that can’t be limited by law, such as for fraud, or takes away rights you have as a consumer under the law where you live.

You agree to cover our reasonable losses and costs arising from claims by others about your content or your breach of these terms.

General

  • These terms, together with our privacy policy and any order for a paid plan, are the whole agreement between you and us about the service.
  • If part of these terms can’t be enforced, the rest still applies.
  • If we don’t enforce part of these terms straight away, we can still enforce it later.
  • You can’t transfer these terms to anyone else without our agreement. We may transfer them as part of a sale or reorganisation of ChimeIn.
  • We aren’t responsible for delays or failures caused by events outside our reasonable control.
